CCPA/CPRA NOTICE TO CALIFORNIA RESIDENTS

California residents have certain rights under the California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”). Pursuant to the CCPA and CPRA and other California privacy laws, Management Health Systems, LLC d/b/a MedPro Healthcare Staffing and MedPro International (both referred to herein as “MedPro”) is providing the following information to visitors, users, and others who reside in the State of California. MedPro’s California Privacy Policy describes its online and offline information practices as well as informs consumers about the rights they have regarding their personal information and provides information necessary for them to exercise those rights.

CALIFORNIA PRIVACY POLICY

This California Privacy Policy supplements the information contained in the Privacy Policy and applies solely to California Residents. This section describes your rights under the CCPA and CPRA and other California laws. Any terms defined in the CCPA and CPRA have the same meaning when used in this section.

While we have set out the categories below as required by the CCPA, you can review our Privacy Policy for examples and other information that describes our data collection and use, which will not change under this notice.

Management Health Systems, LLC d/b/a MedPro Healthcare Staffing and d/b/a MedPro International (“MedPro”) adopts this Notice at Collection for California Employees and Job Applicants Only (the “Notice at Collection”) to comply with the California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”). Any terms defined in the CCPA and CPRA have the same meaning when used in this Notice at Collection. Employees and job applicants who reside in California may have rights regarding their “Personal Information” and “Sensitive Personal Information” as defined by the CCPA and CPRA (collectively referred to as “personal information” unless otherwise specified). This Notice at Collection describes how MedPro collects, discloses, and uses your Personal Information and Sensitive Personal Information, what categories of Personal Information and Sensitive Personal Information it collects as well as how it is used and for how long it is kept.

PERSONAL INFORMATION WE COLLECT

Below are the categories of personal information we may have collected from you in the preceding 12 months as well as the categories of personal information we may collect from you, and examples of each:

This includes information such as your name, phone number, postal address, telephone number, IP address, email address, account name, Social Security number, driver’s license number, passport ID, date of birth, and employee ID.

This includes identifying information such as your name, Social Security number, address, telephone number, driver’s license number, education history, employment, employment history, bank account information, medical information, and health insurance information.

This includes information such as your age, gender, sexual orientation, preferred pronouns, marital status, ethnic information, veteran status, disability status, and citizenship information.

This includes information such as your browsing history, browser name, domain type, operating system information, IP addresses, access times, and device identifiers.

This includes information such as voice recordings.

This includes information such as your education and employment history, credentials, background-check results, drug-screening results, sanctions history, work authorizations or work visa information (including any information provided by you for a dependent visa), work restrictions or accommodations,  emergency or beneficiary contact information, and data contained in your resume.

This includes information on your location when you visit our website or use our application.

We draw inferences from the above information to create a profile about you.

We also may collect the following types of sensitive personal information: citizenship or citizenship status; health, genetic, and biometric information; immigration status; passport, Social Security, driver’s license, and state identification numbers; account logins; financial details (including bank account and credit card details); racial and ethnic origin; religious or philosophical beliefs; sex life and sexual orientation; precise geolocation; and union membership.

Our sites, apps, and services are meant for adults. We do not knowingly collect personal information from children (anyone under the age of 18) without permission from a parent or legal guardian. WHY WE COLLECT PERSONAL INFORMATION

Our purposes for collecting and using your personal information include human resources, employment, benefits administration, health and safety, and compliance. Many of these business purposes require that we disclose your Personal information to third parties such as clients and service providers. While we do not provide your Personal information to third parties in exchange for money, we do permit trusted partners to collect certain information about you when you interact with our website so that they can provide you targeted advertising based on your online interactions with us and others. This practice may be considered as “selling” or “sharing” your Personal information. Further, we may allow companies to collect the following categories of personal data for targeted advertising: Internet and Other Electronic Network Activity Information. We may also disclose or transfer your personal information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business or assets (including in connection with any bankruptcy or similar proceedings). We reserve the right to share your personal information as described and disclosed to you by MedPro in a separate writing or communication as well as share your personal information as required or permitted by law. Given that we limit our collection of data concerning minors, we do not have actual knowledge that we allowed those companies to collect information on anyone who is younger than 18 years old.

For example, the Company collects and uses your personal information as appropriate to:

  • Comply with applicable laws and regulations.
  • Improve our services.
  • Recruit and evaluate job applicants and candidates for employment.
  • Conduct background checks.
  • Engage clients for employment opportunities for job applicants and candidates.
  • Manage your employment relationship with us, including for:
    • onboarding;
    • timekeeping, payroll, and expense reports;
    • employee benefits;
    • employee training and development;
    • the creation, maintenance, and security of your online employee accounts;
    • reaching your emergency contacts when needed, such as when you are not reachable or are injured or ill;
    • workers’ compensation claims management;
    • employee job performance, including goals and performance reviews, promotions, discipline, and termination; and
    • other human resources purposes.
  • Manage and monitor employee access to company facilities, equipment, and systems.
  • Conduct internal audits and workplace investigations.
  • Investigate and enforce compliance with and potential violations of MedPro policies and procedures.
  • Engage in corporate transactions requiring review of employee records, such as for evaluating potential mergers and acquisitions of MedPro.
  • Maintain commercial insurance policies and coverages, including for workers’ compensation and other liability insurance.
  • Perform workforce analytics, data analytics, and benchmarking.
  • Administer and maintain MedPro’s operations, including for safety purposes.
  • Market our services to clients and prospects.
  • Exercise or defend the legal duties or rights of MedPro and others, including its employees, affiliates, customers, contractors, service providers, and agents.

HOW LONG WE RETAIN YOUR PERSONAL INFORMATION

In general, we keep your information for as long as we need it to carry out the purposes described above, and as necessary to comply with our records-management policies. We also keep your personal information as necessary to comply with other legal obligations we might have, such as in connection with litigation.

YOUR CALIFORNIA PRIVACY RIGHTS​

The right to know what personal information MedPro has collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom MedPro discloses personal information, and the specific pieces of personal information the business has collected about you.

The right to delete personal information that MedPro has collected from you and retained, subject to certain exceptions.

The right to correct inaccurate personal information that MedPro might have on you.

The right to opt-out of the sale or sharing if MedPro sells or shares your personal information.

The right to limit the use or disclosure of sensitive personal information by MedPro, if it uses or discloses sensitive personal information for reasons other than those permitted by the CCPA/CPRA.

The right not to receive discriminatory treatment by MedPro for the exercise of privacy rights conferred by the CCPA/CPRA, including an employee’s, applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their CCPA/CPRA rights.

EXERCISING YOUR CCPA/CPRA RIGHTS

California residents may submit CCPA requests themselves or by using an authorized agent.

CCPA requests are subject to our verification measures, which vary depending on the type of request made and the sensitivity of the information you request. We may ask you to provide a few pieces of information to confirm your identity in our records. If you authorize an agent to submit a request on your behalf, we may require the agent to provide proof that you gave the agent signed permission to submit the request and may verify the agent’s identity and authority to act on your behalf.

You may only submit a request to know twice within a 12-month period.

Your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

You do not need to create an account with us to submit a request to know or delete.

We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

RESPONSE TIMING AND FORMAT

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us by calling the toll-free phone number 800.886.8108 or emailing privacy@medprostaffing.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

Any disclosures we provide will only cover the 12-month period preceding receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

NOTICE OF RIGHT TO OPT-OUT OF SALE/SHARING

Any terms defined in the CCPA and CPRA have the same meaning when used in this Notice of Right to Opt-Out of Sale/Sharing. “Sale” is defined very broadly by the CCPA/CPRA. Depending on the relationship MedPro has or has had with you, we may share your information in ways that could be deemed a “sale” for purposes of the CCPA/CPRA. Management Health Systems, LLC d/b/a MedPro Healthcare Staffing and d/b/a MedPro International (“MedPro”) adopts this Notice of Financial Incentive for California Employees and Job Applicants Only (the “Notice of Financial Incentive”) to comply with the California Consumer Privacy Act (“CCPA”) and California Privacy Rights Act (“CPRA”). Any terms defined in the CCPA and CPRA have the same meaning when used in this Notice of Financial Incentive. The purpose of the Notice of Financial Incentive is provide you with information regarding any financial incentive or price or service difference that we may provide in exchange for your “Personal Information” and/or “Sensitive Personal Information” as defined by the CCPA and CPRA (collectively referred to as “personal information” unless otherwise specified).

In order to participate in our rewards program(s) and use our services, you may provide personal information from time to time, directly or indirectly, in exchange for cash, gift cards, or other financial incentive, or price or service difference, the amount or nature of which will be specified in each instance at the time the personal information is to be submitted.  You can opt into the financial incentive or price or service difference by submitting the personal information. If you wish to opt-out of the financial incentive or price or service difference, do not submit the personal information.

In some instances, you may have the opportunity to provide personal information on an ongoing basis in exchange for cash, reward points, or other financial incentive, or price or service difference, on an ongoing basis, the amount or nature of which will be specified in each instance at the time the personal information is to be submitted.  You can opt into the financial incentive or price or service difference by submitting the personal information. Each financial incentive or price or service difference related to submission and use of  personal information is based upon our reasonable but sole determination of the estimated value of such information, which takes into consideration, without limitation, estimates regarding the anticipated revenue generated from such information, the anticipated expenses which might be incurred in the collection, storage, and use of such information in the operation of our business, and other relevant factors related to the estimated value of such information to our business, as permitted under the CCPA and CPRA.

California Civil Code Section 1798.83 permits visitors, users, and others who reside in the State of California to request, once a year, certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
